One of the most frequent doubts we receive in Drisar Advisors is yes yese can be self-employed and work for a company at the same time.
Yes, it is possible, as long as your company allows it, that is, you must verify that you have not signed any exclusivity clause at the time of your contract.
The self-employed they can start to develop any activity and work for a company at the same time, this is called Pluriactivity. In this article we will explain all the aspects to take into account so that you can carry out both activities.
What is Pluriactivity?
This is the possibility of working for a company, being registered in the General Scheme, and in turn carrying out some activity on their own, having been registered in the Special Scheme for Self-Employed Workers. This means that you can contribute in both schemes, as an employee and as a self-employed person.
In the event that the contributions exceed the limit established by Social Security, this amount will be repaid ex officio by this body, which gives you the right to have two pensions when the time comes for your retirement. Note that you must contribute to each scheme independently.
How much should you pay as a self-employed person if you work for someone else?
Bearing in mind that you already contribute to Social Security because you are working for someone else, when you register as self-employed, the fee you must apply will be less than the established one. In this case, the process to register as self-employed remains the same, however, the process to register with Social Security is different.
As you are already contributing to Social Security, you have a bonus percentage that varies depending on the working day for another's account with which you comply.
Depending on the day, it is divided as follows:
If you are employed full time
- You have a reduction of 50% of the minimum base during the first 18 months.
- During the following 18 months, the reduction is 75% of the minimum base.
If you work for someone else part-time
- The reduction during the first 18 months is 75% of the minimum base.
- During the following 18 months, the reduction will be 85% of the minimum base.
This reduction percentage will be applied if you register as self-employed for the first time and start a new activity while in a multi-activity situation. It is important to mention that you will not be able to benefit from the flat rate, because the reduction in a situation of pluriactivity does not allow you to have access to any other bonus.
How do you pay taxes in a multi-activity situation?
Being in a multi-activity situation generates a double obligation when paying taxes:
For income received as self-employed
- You must make a quarterly personal income tax return, using model 130 if you pay taxes by direct estimation and if you pay taxes by modules using model 131.
- Make the quarterly or monthly VAT declaration with form 303.
- Make the rest of the relevant declarations if your activity falls within the assumptions, such as rentals or exports.
For the income you receive from the activity as an employee
As usual in your monthly payroll, the reduction of your withholdings will appear. These withholdings will be included in your Annual Income.
Having the consideration of Pluriactivity entails the obligation to do the Income Statement annually, this obligation is acquired by the I work on my own accord, that is, due to economic activity, since it is possible that initially as a salaried worker you did not meet the minimum requirements to have to present the income tax return.
You must bear in mind that you must not make two separate declarations, in this case you have to add the total income obtained, that is, those that come from your activity as a self-employed person and those that you receive for the activity as an employee.
On the other hand, the situation of pluriactivity also generates a double obligation before Social Security. Your boss must continue to pay the social security fee corresponding to your registration as an employee, while you must face your fee as a self-employed person. If you are thinking of being in a multi-activity situation, it is important that you analyze whether the extra income that you are going to obtain as a self-employed worker compensates for the double payment of Social Security contributions and the increase in personal income tax.
It is a delicate situation in which many factors must be taken into account and which must always be dealt with by a professional, since the greater the range of activity, the more obligations are covered.
