maternity or paternity leave

maternity or paternity leave

It is a right that all workers who contribute to take a leave of a few days in the event of the birth or adoption of a child to facilitate their care.

How long is maternity or paternity leave?

From January 1, 2021, maternity and paternity leaves were equalized at 16 weeks, individual and non-transferable right. That is, if one of the parents does not enjoy all that time, it cannot be transferred to the other.

Amount that a self-employed person receives for maternity or paternity leave

In which case the self-employed must take maternity or paternity leave, receive an amount as if it were a common sick leave. However, the benefit they receive is 100% of the regulatory contribution base. When having a child, the self-employed person is entitled to a 16-week leave, which in the case of maternity can be extended if there were complications during the delivery or if it is a multiple pregnancy.

Are there benefits for maternity/paternity?

Yes, in fact there is aid for both the mother and the father, this aid is except for the employer (if they work for someone else), they are personal aid and must be requested through Social Security.

In 2022 we have the creation of a new help of up to 100 euros per month for each dependent child for families who receive the Minimum Vital Income (IMV) or who have low economic income.

Nursing Permit How long does it last? When can it be taken?

Nursing leave lasts from the end of paternity or maternity leave until the child is 9 months old. (But also with the latest reform "it is possible to extend the leave until the child is 12 months old, although with a proportional reduction in salary from the ninth month)

And it can be taken from the moment the parent returns to work after sick leave. That is, in the case of the mother from the 16th week if she only had one child.

What does the new infant care permit bring us?

We tell you below the three possible ways to enjoy it:

  • Both parents have the right to be absent from work for one hour each day or two fractions of half an hour within the working day.
  • Both parents can reduce their working day by half an hour. In this case, workers will be able to enter or leave half an hour before their usual schedule.
  • Accumulated leave: If the collective agreement contemplates it or an agreement is reached with the company, the sum of the hours of the nursing leave can be made and transformed into full days.
